Imagine a system of “academic freedom” where you can fired for, say, pointing out that the unemployment rate is higher for non-White Americans than for White Americans.

As if pointing out facts is a crime.
Without academic freedom, academics cannot ask critical questions, conduct new research or feel secure to challenge established orthodoxy. This is a clear violation of such freedoms at the centre of the modern university. This is an affront to the academy.

We need more Canadian studies/surveys digging down into opinions of Canadians on unions and collective bargaining.

The data we have is dated. Where are our big survey folks?

At a time when Americans cannot agree on many things, unions have achieved popularity across nearly every age group regardless of partisan affiliation or education.

PS It was great as always to see you offline @eidlin.bsky.social (truly, you are always offering solid, empowering perspectives on labour and are the best dressed in the room! an icon!!) and it was amazing to meet you, @thelawofwork.bsky.social (and while I'm striking, at that!).

I’m noticing a trend in employer/employer counsel arguments about scope of constitutional right to strike in Canada.

Their argument is that the SCC didn’t actually recognize a “right to strike” in the SFL case.

Instead it recognized a right to neutral arbitration. Thus, govt’s can just impose arb.

Can’t say I enjoyed the full winter experience in Montreal this week, but was great to hang with Professors @eidlin.bsky.social and
Dalia Gesualdi-Fecteau and talk about labour law and other less work-y stuff.

In the wake of the Panama Papers scandal, Kevin O'Leary said he'd take his marbles and leave if Canada tried to reduce the tax shelters that protect the rich from paying their fair share.
My response: How can we miss you if you won't leave?

Oh sure I’ve been cited by Supreme Court of Canada and other Canadian courts, but now that I’ve been cited by the Appellant Division of the Caribbean Court of Justice I can retire.

Thanks everyone and have a nice life.

It’s finally happened. I’ve reached that age when I no longer know any Grammy nominated songs or albums.

Okay, I know one song. The Subway by Chappell Roan, but that’s only because my spouse likes her.

I don’t even know any of the Rock songs or albums. Wow.

What is a "volunteer"?:

Papa Murphy’s v Manmeet Kaur, 2025 ABESAB 16 canlii.ca/t/kg7tv

For-profit pizza company claims worker was an unpaid volunteer. As if. Board finds "employment" relationship.

For me, if (1) worker does real work & (2) the business is for-profit, worker is not a "volunteer".

Federal government plans to follow Ontario’s lead, prohibit non-competition clauses in employment contracts.

The rest of country should similarly ban non-competes. As I explain in this article, most non-compete clauses are illegal anyways and they are bad policy:

Non-Competition Clauses in Canadian Employment Law and the Doctrine of Inequality of Bargaining Power
In 2021, the Ontario government legislatively prohibited most non-competition clauses, the first Canadian government to take this step. The move was unexpected

Submitted second grant application today, two grants for two entirely different projects. A LOT of work.

But I can finally get to the pile of other work waiting for me, including a new book on collective bargaining and law.

First tho, a new cliff scape painting. Layers 1-4 of probably 20!
