this has been one of my central arguments the past ten years. the theory underpinning the anti-democratic elements of the american constitutional order is wrong!
The more democratic elements of the American constitutional and economic order are actually throwing up road blocks to Trumpism. Protests and boycotts and low level courts and juries and cetera. Elite actors on the other hand are all too frequently caving. Fascinating study in who actually cares!

Once again, SCOTUS undermines the rule of law, its own legitimacy, and the lower federal courts with a 'back of the napkin' explanation that doesn't even bother to analyze the issue under the standards for staying an injunction—all to enable a bigoted attack on a targeted group.

The fact that it will take close to a full year for this blatantly illegal bullshit to stop even though it’s cost a mountain of money is a sad commentary of our justice system.
A takeaway here is that normally a Republican administration can get away with submitting Steve Bannon monologues as briefs because the outcome is pre-determined, but in the rare politically salient case where Republican justices are cross-pressured the intelligence-insulting bullshit is a problem

Can’t have a proper democracy without proper representation.
What's happening in TX-18 is more obscene than not seating Grijalva during pro formas. Turner died in March. Abbott delayed the special election until yesterday, and now it goes to a runoff early *next year.*

Congress can and should require special elections to be held within 90 days of a vacancy.

While it's good Trump will likely lose this case, this does not change the fact that SCOTUS continues to build a made-up, Calvinball jurisprudence including the Major Questions Doctrine and (coming soon) the Unitary Executive BS, that will be weaponized against the next democratic president.
My general thought from listening to SCOTUS in the tariff case is that some conservative justices (Roberts in particular) want to use the major questions doctrine to strike this down so they can say they apply it equally and maintain it as a tool to stop any progressive advances.
