Under current federal law, this is actually a great question with only bad answers, I fear. An early gift from the Roberts court.
Fun fact: When he was general counsel, the current OU president co-authored an article that begins with:

this is known as a Kavanaugh Rest Stop
ICE agents illegally break into a woman's bathroom in a NY nutrition bar manufacturing plant. "Pull up your pants," says a male agent. The agents only had a warrant to review employer documents. They didn't have a warrant to search for, detain, or arrest anyone there.

And I say this to mean, 100% checking will start meaning checking the cases your cited cases cite. That should already be the case for some types of legal work, but I've seen that failure mode happen too often before AI. It's only going to get worse with more AI.

I'm not sure we are to the point of it fully generating cases, not just citations, but given the tendency to propegate cites forward (b cited a so I'll cite a in c), this stuff is going to be really bad if it comes up with full cases like what's happening with academic articles.

suspect a big reason why many academics and others who work in areas where getting facts RIGHT is key are disinterested in using LLMs for research:

they’ve tried it, they keep noticing major errors in output, and they conclude that having to verify all that doesn’t actually save them time.
