Last year I planned a Christmas market girls trip for friends & I. I’m missing those vibes this year (& traveling in general due to buying a house) I hope you all don’t mind a trip down memory lane this month bc I took SO many pics. Everything was ridiculously charming. We stayed in Colmar FR 🎄

Feldman, counsel for Defendant Affable Avenue LLC ("Affable"), filed a brief in support of Affable's motion to dismiss that was peppered with false citations. Concerned about both the genesis of these misstatements and counsel's delay in correcting them, the Court issued an Order to Show Cause. Perhaps not appreciating the gravity of the situation, Mr. Feldman responded to that Order with a submission that appeared to have been created by generative artificial intelligence ("Al"), and that itself contained a false citation. The Court's response was stern and unmistakable: "Mr. Case 1:24-CV-09429-KPF Document 227 Filed 02/05/26 Page 2 of 33 Feldman [wals not excused from this professional obligation [of verifying that the cases he submitted to the Court were valid] by dint of using emerging technology." (Dkt. #169 at 4). Mr. Feldman persisted. A few days prior to the Court's hearing on the Order to Show Cause, Mr. Feldman submitted a proposed reply brief in further support of Affable's motion to dismiss. Once again, his brief contained false citations. And at the August 22, 2025 hearing, Mr. Feldman was unable to respond directly to, much less answer, the Court's questioning about his submissions. Mr. Feldman has not, and apparently cannot, learn from his mistakes. And while the Court does not oppose the use of Al to assist in legal research and writing, it must take a stand where, as here, counsel repeatedly files submissions with false citations because counsel refuses to verify those submissions. This Court can do no more. For the reasons that follow, the Court sanctions Mr. Feldman pursuant to Federal Rule of Civil Procedure 11 and the Court's inherent powers by striking Affable's submissions and entering default judgment against it.

MR. FELDMAN: Because when I -- because the -- there was a nuanced argument that I was trying to change and make, which I was not ultimately able to make. However, originally the focus was on -- the focus was, for my arguments, was originally on the standard -- whatever was in the prior submissions because of this change, I felt because of something called, which I believe -- and again, there isn't much case law about it. But it is the concept of estoppel, and it is used in the context of unions and pension funds where if you are a party to a collective bargaining agreement that has an arbitration clause, or you have a -- or you are a party to or you - either receive benefits from that agreement, and even if you are not on the agreement, you are really just a me too. THE COURT: I really appreciate, Mr. Feldman, you trying to teach me the law of -- MR. FELDMAN: I'm just -- THE COURT: No. But even as you describe it, you are trying to use it offensively against an entity that according to the complaint your client harmed by taking their products. I'm not there, sir. I keep asking you, and I'm not sure why you are refusing to answer me. I am asking you how you put together the actual memorandum you filed by me, which has none of this discussion of the arbitration issues with Amazon.

Yesterday was day 2 of my mini-signing tour for Wooing the Witch Queen, traveling around different wonderful Welsh Waterstones while WtWQ is Welsh Book of the Month! So prepare for happy photos. :)

I started out at @swanseastones.bsky.social , a bookstore (and city!) I've loved for a long time:

Screen shot of a Facebook post: Terri Brisbin 10h I've been asked about the rumors about Harlequin/Mills&Boon's Historical line closing down. Sadly, it true. Authors in the line were told yesterday but we're in shock at this point and still sorting through contract questions, etc. The last Historicals will release in English in September 2027 (spine date October 2027). All backlist books will continue on-sale and foreign languages will continue too. I've written for them since 2000 and i think the book i just turned in was my 35th for them. It's a shame the line never got the promotion or narjeting that other lines did and that it was nearly invisible to readers. But, at least our fabulous stories will still be available to readers. I hope you'll still give us a try!
