Awesome! Just in time for my posts next week that include that Tom Waits example to illustrate right of publicity!

Expect that Waits v Frity-Lay case to be cited in plaintiff briefs and judicial rulings. Also the Bette Midler v Ford case.

You'd think marketing firms would learn, but clearly not.

We go out for Thanksgiving now because doing all that cooking and cleaning up the mess for our tiny family doesn't make sense, but in the last few years we did bother to cook, I was removed from pumpkin pie duty because I forgot to add the sugar. Don't bake while working, folks!

One of my favorite things about being a solo attorney is that I don't have a boss telling me my social media content is "too weird" or "too political"!

When I was 17, I worked concessions and ticket sales at a recently converted art house theater that had been a porn theater not long before that, and I've been practicing law for over 25 years, so it's hard to shock me or gross me out. Yet. Ew. I'm glad my niche isn't porn trademarks.

IP is not like a regular asset that upon their death will either transfer automatically or be handled easily by the executor. IP is different. Patents and trademarks require active maintenance and use to survive and special documents to transfer ownership.
