Kristin Hickman is an American legal scholar known for her work in the fields of administrative law, tax administration, statutory interpretation, and tax law. She is a Distinguished McKnight University Professor and the Harlan Albert Rogers Professor in Law at the University of Minnesota Law School. Her work is regularly cited by United States Courts, including the United States Supreme Court. The amount of fraud coming to light in Minnesota is alarming. We're super excited about this paper, which provides empirical evidence regarding common critiques of OIRA review, some really interesting insights into the tax regulatory process, & potential lessons for OIRA review of independent agencies.

Here is the abstract: Conventional wisdom treats the federal civil service as largely beyond the president’s reach. This Article challenges that assumption. Legal scholars too often focus on constitutional powers rather than statutory authority. Yet the president has possessed statutory authority to regulate entrance into the civil service and the conduct of federal employees since before the passage of the Pendleton Act.

For those who follow tax & admin, the 8th Circuit just reversed the Tax Court in favor of the taxpayer in the big 3M transfer pricing case, citing Loper Bright plus the #SCOTUS First Security Bank decision, & treating Brand X as dead (rightly IMO).

If you're a 1L starting law school in coming weeks, just remember: You're *supposed to* feel a bit confused at first. It's normal. Law is like a language. You learn it best through immersion. You'll take a few weeks to get to speed.
