State action. Only way the Constitution applies is if it is State action…
Your First Amendment right to personal political speech does not protect your speech from your employer unless your employer is the government. There are rare statutes that might protect you from a private employer firing you but not the First Amendment.

So many thoughts on today but the idea that the wardrobe of those in the meetings today had something to do with what happened is summed up far better with @dieworkwear.bsky.social thread than anything I can do.

In short—tie, no tie, the yelling happens and everything else is subterfuge.
There has been a lot of chatter today about Zelenskyy's meeting with Trump, some regarding this moment when White House correspondent Brian Glenn asked if the Ukrainian president plans to wear a suit. I want to address idea in this thread. 🧵

It’s also a shame there is not a beloved television show that could explain this process to those elected representatives.

Well, they did it.

Property rights in Nevada are a little stronger after a very well reasoned decision from Judge Steinheimer. This fight certainly is not over, but today, today is a good day for liberty in the Silver State.

America lost another great Sailor today. Your contributions to our seafaring Nation are well documented. His contributions to genuine humanitarian and good causes is equally well document and equally impressive. Rest in power Jimmy Carter.

I called it weeks ago that @stevevladeck.bsky.social would rabble rouse the 5th Circuit with the CTA decision…
On one hand, this whiplash is causing a lot of headaches for a lot of lawyers and their clients.

On the other hand, it’s exposing a lot of folks who don’t follow the Fifth Circuit closely to a day in the life of following the Fifth Circuit closely.

Welcome! We have t-shirts (and manila folders).
The Corporate Transparency Act case trundles on. While the en banc petition on the motions panel’s stay was pending, the brand new merits panel of the Fifth Circuit reinstates the stay itself. So all you compliance people at companies can chill.

Honestly, slippers are the most thoughtful gifts for parents with small children because it protects you and makes sure you don’t slip and almost break your neck Home Alone style. To say the least, I am so happy with my new slippers in spite of the thousands of new small toys in my home now

4 - okay this is too angry ::edits::

Can state officers search or arrest for federal marijuana offenses where state law has legalized it? Difficult question, fed court concludes. But this is a govt motion for reconsideration, so error has to be clearly established. Open question, so govt loses. drive.google.com/file/d/14uE6... #N

This is great
Sometimes there's nothing more fun than being a lawyer. Imagine how much fun Olivia Troye's lawyer had answering the idiotic complaint from Kash Patel, whining that he would sue if she kept saying he was unfit to run the FBI. This is one for the ages.

This is the portion that I 🤦🏻‍♂️ because it just seems very very wrong from a legal reasoning perspective. The law imposes real costs that’s for sure, but the grounds in which the court struck it down seems…wrong
I thought no one could defeat me in enthusiasm for supporting corporation's rights, but this analogy does not strike me as right --> A corporation having to disclose is the same as an individual having to buy health insurance.

Logos and emblems are sacred across sports. Denigrating them has been an instant fire starter for years.

@jasonlloyd.bsky.social writes that rivalry games are emotional enough without planting flags. Winners must act with class, too.
