My paper, Habeas and the 1948 Judicial Code, is forthcoming in the Stanford Law Review (@stanlrev.bsky.social).

I argue that the 1948 Judicial Code, not the 1867 Habeas Corpus Act, should be the statutory focus for inquiry into the scope of habeas review.

“Black” is being flagged as a potentially prohibited word violating anti-DEI law at multiple Florida Universities. My interview this week with @grundrza.bsky.social documents his event being flagged because the flyer said “Black.”

Racial authoritarianism is here, it’s just unequally distributed.

JUST IN: A federal judge has barred ICE and DHS from using taxpayer information provided by the IRS.

Judge Talwani says that DHS' view that noncitizens lack 4th amendment rights — combined with ICE use of administrative warrants — is a recipe for abuse.

‘One officer told me that I "had no chance of returning to Minnesota" and that "the best thing for (me] is self-deportation." …
She offered me $2600 to self-deport.
I refused.
I wanted to talk to my attorney.
They didn't tell me the judge had already ordered my release and return to Minnesota.’

y’all know I was skeptical but Spanberger has been great. Her people have been great. Had a meeting earlier today with some of her folks and they’re saying exciting things about employee rights and enforcement.

very happy so far.
NEW: Abigail Spanberger this afternoon ordered that all state agencies leave ICE's 287(g) program.

This means that the state police (and some other agencies) will no longer be empowered to detain and arrest people for ICE.

Big, big move by the governor within weeks of coming into office.

Abigail Spanberger left the 287(g) program, which empowered state law enforcement to detain immigrants. Will Democrats also bar local police and sheriffs from the program?

Important info from @cato.org about how immigrants contribute to our country:

"The US immigrant population generated more in taxes than they received in benefits from all levels of government every year from 1994 to 2023."

Facts matter.

The @nytimes.com coverage of France's Grok investigation casts it as part of a conflict between U.S. & European speech rules. That's true only if you buy Elon's version.

This is a case about CSAM and NCII. Those are crimes in France, and crimes in the U.S. There's no transatlantic divide here. 1/

There are plenty of *real* divisions between the U.S. and EU in speech laws for hate, disinformation, etc. But *not* about this.

It takes a very talented huckster to convince the world that purveying literal child sexual abuse material makes Elon an American speech hero fighting French oppression.

He's used the platform to call coverage of his emails with Epstein as "lies," elevated his fans who have defended him, and gotten positive reinforcement from his AI chatbot.

They're worried about "looking weak" for voting "against law enforcement" when they should be worried a mob of housewives is going to come beat them to death if they do.
