NEWS: DOJ quickly filed a notice of supplemental authority at the Ninth Circuit in Newsom v. Trump — where oral arguments are scheduled for Wednesday on the merits of the TRO appeal in the California case — citing the 2-1 Ninth Circuit stay decision from Monday in the Oregon case.
Dear Ms. Dwyer: The federal government writes to provide notice of a pertinent and sig- nificant legal authority: the published stay decision in Oifqgo7z W. Twmfp, No. 25- 6268 (9th Cir. Oct. 20, 2025) (per curiam). See Attachment A. In response to a sharp increase in violent protests that are aimed at thwarting the enforcement of federal law, the President federalized and deployed the National Guard to Port- land. He did so pursuant to 10 U.S.C. § 12406, the same statute at issue in this appeal. Almost immediately, the State of Oregon and City of Portland sued, challenging (among other things) the President's federalization decision. After briefing and argument, an Oregon district court entered a temporary restraining order. Defendants appealed and sought a stay pending appeal. In a precedential decision, a panel of this Court granted a stay pending appeal. Largely, the Oregon decision reaffirms the legal conclusions from the stay decision in this case. See Slip. Op. 20-21 (discussing Ney/sow u Twzwp, 141 194th 1032 (2025) (per curiam)). But the Oregon decision also expounds on how those principles must be applied. The "high deferential standard" applied in Ney/sow does not allow district courts to "substitutel] [their] own assessment of the facts for the President's assessment of the facts." Slip Op. 23. This means that a district court cannot artificially narrow the set of facts that inform the President's decision. See Slip. Op. 23-26 (discussing temporal restriction). Nor can district courts "discountl], minimize], and discreditl] ... undisputed evidence" to sec- ond-guess the President. Slip OP. 27. As this makes clear, even assuming the President's decision is reviewable, that review must be exceedingly circumscribed. Applied here, for all the reasons set forth in defendants' brief, the record amply supports the President's judgments. In 2020, while reporting on a protest for a local newspaper I was wrongfully arrested by officers who were masked or concealed their names/badge numbers. I had photos of two of their faces and sued, but the department refused to provide information to identify them, and the lawsuit was dismissed

In response to California passing a law limiting law enforcement officers' ability to conceal their identities, the president of the Peace Officers Research Association of California contends that police are not subject to democratic control.

Brian R. Marvel, the president of the Peace Officers Research Association of California, which represents over 87,000 public safety officers, said he was outraged by the passage of the law. He said in a statement that he believed that California did not have the authority to regulate federal agents, so it would ultimately apply only to local law enforcement officers, which he called a “troubling betrayal that California’s local law enforcement community will not soon forget.” He said that limiting face coverings and opening officers up to prosecution would most likely hurt recruitment and drive officers from the state.
