It'd be great if the government loses on its insane tariffs, but if the end-result is a massive expansion of the major questions and non-delegation doctrines, that's not great in the long term...

I spoke with @ariquelmy.bsky.social (@courthousenews.bsky.social) about why California's new law that will ban ICE agents and other federal law enforcement officers from wearing masks on duty likely violates the Supremacy Clause. Check out his article below!

ICE unmasked: California officials clash over enforcement of looming law
Some legal experts say the no-mask mandate will likely be struck down — and one top prosecutor is already advising federal agents to ignore the new law set to take effect next year.

Harvey.AI is courting law schools like Westlaw/Lexis once did, but do we really need it? After a demo, my verdict: it's ChatGPT in a black turtleneck. Good for firms needing secure doc review & RAG, but law students can already do most of this with existing tools. matthewsag.com/do-law-schoo...

I defended the TikTok law, and the courts agreed. But I got the institutions wrong. In @lawfaremedia.org I analyze the 3 institutional betrayals that defined this sorry saga: executive non-enforcement, congressional indifference, and corporate capitulation. www.lawfaremedia.org/article/less...

Many thanks to Toledo Law School for inviting me to give the Stranahan Lecture last week. My talk, “The Unitary Artificial Executive,” argues that AI will supercharge presidential power—expanding both what the the executive branch does and presidential control of it. www.youtube.com/watch?v=OUfM...

On Oct. 23, @alanrozenshtein.com gave remarks on how artificial intelligence could eliminate many of the remaining constraints on presidential power at the University of Toledo Law School’s Stranahan National Issues Forum. Read his speech: www.lawfaremedia.org/article/the-...
The Unitary Artificial Executive
Previous expansions of presidential power were still constrained by human limitations. Artificial intelligence eliminates those constraints.

There a bunch of policy areas where I differ from Sen. Wiener, but I was enormously impressed by how thoughtful and substantive he is. Really great conversation.
If states are laboratories of democracy, then @scottwiener.bsky.social is one of the most prolific scientists.

Sen. Wiener explains California's many AI policy experiments in an episode w/ @alanrozenshtein.com & @kevintfrazier.bsky.social.

The trio cover SB 53, SB 1047, and breakfast tacos.

I glanced down at the message.

“Anna, Lindsey Halligan here,” it began.

So began my text exchange with the woman who is prosecuting the president's perceived political enemies.

This should obviously be the policy of any reputable news organization. And Hegseth is Secretary of Defense, not War.
Good

**Please note, as a matter of house style, War on the Rocks will not use a different name for the U.S. Department of Defense until and unless the name is changed by statute by the U.S. Congress.
