5th Circuit: TM owner cannot "infringe mark he owns," in case of one band member suing the others for use of the band name. TMs indicate a single source, not multiple sources. In a dispute among co-owners, a cause of action would fall outside Lanham Act.

Lululemon has sued Costco for trademark infringement for Costco's selling of "knockoffs" under its house Kirkland brand name. The knockoffs are allegedly very similar to the Lululemon designs and include sweatshirts, jackets and pants.

I have only parsed through a small part of the Trump v. Casa ruling (it's 119 pages, including dissenting opinion), but I'm curious what, if any, is the effect of striking down universal injunctions will have on patent and trademark cases?

Judge Alsup’s order on fair use has dropped. Anthropic’s use of books to train its Claude AI system is “transformative use.” However, Anthropic’s piracy of the books is not and subject to further litigation.
