The practical effect of overturning Humphrey’s will be that Republican presidents can stack the formerly independent agencies with their copartisans and SCOTUS will be cool with everything they do but when a Dem POTUS does the same Roberts et al will declare all those agencies’ actions unlawful.
In a memo John Roberts wrote just 4 yrs out of law school, he said the “time may be ripe to reconsider the existence” of independent agencies & bring them back into the executive branch. Now he’s poised to end what he has long called “a constitutional anomaly.”

After all it would be jobs lost as well as campaign funding.
With the new administration’s announced foreign policy to back away from alliances like NATO, the defense budget could be cut by 20%, right? No foreign outposts would exist presumably. So watch carefully to see how the defense industry responds. I expect many legislators to push back on Trump

Total federal spending is up +7% in 2025 over 2024 year-to-date to Oct 20.
The story that the fed govt is tightening its belt is contradicted by its own real-time expenditure data. Admin spectacularly hammering some things but raising spending elsewhere.

I would like to see protestors shouting phrases such as “WE are what is great about America!!!” Or
“We ARE America!!” Or anything along those lines. The right keeps chanting “USA USA”. We need something like that.

@profmmurray.bsky.social and her Strict Scrutiny colleagues have regularly noted the problems arising from the well named “shadow docket.” While the merits docket sets precedent (Thomas’ comments notwithstanding), how can the shadow docket be anything more than advisory? Please embrace this idea.

Having sat on a federal grand jury, the indictment makes sense. I mean, “he might have lied” so let the actual trial happen and the jury decide beyond a reasonable doubt. This is a ham sandwich against Comey.

If shadow docket cases are never argued are the decisions that follow setting precedent? Sort of feels like the decisions should be regarded as executive orders of the judiciary. Not really law. Since SCOTUS regards precedent as advisory, why can’t their shadow docket decisions be advisory only?

I was annoyed by Mike Johnson sending the reps home, but now that he is back on the talk circuit, I realized the break from the lying POS non-Christian “Christian” was really nice.
