FWIW, I see this order as a very encouraging sign for those who are hoping #SCOTUS *denies* the Trump administration’s application.

There would be no need to issue it if the administration had five votes on the other two issues; and this is perhaps the strongest argument against it on the third.
#BREAKING: In the Illinois National Guard case, #SCOTUS is asking for additional briefing on one of the key substantive questions (and one flagged by my Georgetown colleague @martylederman.bsky.social in an amicus brief):

Among other things, this means no ruling until *at least* the week of 11/17.

Escalate and intimidate. That is exactly the playbook.

And it concerns me greatly: You know the Stephen Miller types in this administration are just itching for violence - searching, longing for something they can use as pretext for a drastic escalation so they can finally ditch all restraint.
Having now watched the footage and interview two of the members who were there, the amount of armed, masked federal agents surrounding three members of Congress and a mayor outside the ICE facility was totally unnecessary; the only possible reason for it was intentional escalation and intimidation.

Dear Internet:

#SCOTUS holding that the President can't be prosecuted for official acts does *not* mean, under *any* non-frivolous reading, that the *federal government,* including all of its officers, is immune from civil suits for *its* official acts.

There's just no equivalency between the two.

🚨 NEW: Early this morning, the US Court of Appeals for the Sixth Circuit allowed TN’s ban on gender affirming care for minors to go into effect. (The district court had blocked the law.) The first federal ct op in favor of these laws.
