Whatever happens, the lifetime grant of power over the rule of law to a handful of people requires reexamination. That power, for the health of the constitution — or its continued vitality, to be frank — requires dispersal.
Now seems like a good day to push my plan to fix Court: sortition — with all but the chief justice (whose role is set out in the Constitution) relegated to the appellate courts, and an expanded set of 12 seats filled by annual randomized selection from Senate-confirmed appellate judges.
The Supreme Court has six right-wing hacks who don't actually care about the Constitution, and even after Trump is gone, a revanchist court will remain a threat to liberal democracy.

The very structure of the court — vesting unchecked power for life in a few people, and hoping they'll wield that power in good faith — has led to this crisis. We can't depend on civic virtue as some bulwark against the corruption that now runs rampant.
Yep, the Supreme Court really is just a House of Lords—a purely political branch with bizarre veto power, wielded capriciously and without accountability. Time for massive reform.

As the district court noted, the Trump admin and Texas Republican lawmakers _said_ that they were acting on the basis of race. They said so openly and plainly. Are fact-finders in the lower courts seriously supposed to plug their ears and say “I can’t hear you”?
Texas clearly did a racial gerrymander, which is illegal.

A district court found that Texas did a racial gerrymander, rejecting the new map because it is illegal.

But the Supreme Court reversed it.

Because? Must assume the gerrymanderers were acting in good faith (despite the evidence otherwise).

I also think we all agree that’s not the story’s point, I’m just talking about some small aspect. I’d go further and say I think Malloy knows/would acknowledge the essay didn’t quote the bible, but as Malloy wrote, that’s “the narrative”. Happy to refocus on Kulnecky’s awful goals if you want.
