LLMs are created by unsupervised learning, so I'd argue that the models themselves are in fact uncopyrightable fair use derivative works because this situation needs even less clarity. The only thing you can put a copyright on is the code that generates the model.

Writing code is the easiest part of writing code. Figuring out what code you should be writing is much more difficult and requires being able to get people to articulate what they want and translate that into requirements everyone agrees on.
