However, I'm willing to bet that they will never actually indict anyone, because as soon as someone is indicted their lawyers would be able to ask for the Epstein files for discovery purposes.

Agreed! The couple at the center of that case (David & David) are former students of mine, and one of them made that point to me a couple of months ago when Davis first made the appeal, that her case was really narrow and not at all a suitable vehicle. The court will look for a better vehicle.

you'd have to set some kind of floor on that, otherwise, you'd have people saying - some of your constituents gave you $100 so you can't vote on anything that affects your constituents - like roads, health care, etc.

That is NOT the way constitutional amendments happen, they either begin in Congress (2/3 vote of both houses) and then are sent to state legislators (NOT the people), or a constitutional convention is convened (which requires 2/3 of the states legislatures to do) and no one wants that to happen.

So these Dem Senators could have given away all the leverage, and even if Thune keeps his word, nothing will change because Speaker Johnson is not party to this deal, and probably opposes it, and we're still stuck with a shutdown, and no leverage at all.
