100% this. A bad outcome doesn’t mean the decision was wrong or that a different decision would have yielded a better outcome. This too common framing also shifts the burden from bad faith actors for their villainy to good faith actors for their...pick your poison...ineptitude, weakness, naivete.
I think this framing falls prey to the idea that if only X had been done differently, the case might not have failed—unfortunately, as the article itself indicates, there was really no option but to bring the prosecution in South Florida. sometimes you just lose.
