Patel doesn't know or is more likely lying. It's not just the 5th Amendment, either, it's the 14th amendment applying to state level due process. Plus, there are Supreme Court decisions reiterating that *everyone* inside the US, here illegally or not, get due process rights. Shaughnessy vs US etc.
Quite an exchange just now between Sen. Merkley and FBI Director Kash Patel over whether due process applies to people targeted by the Alien Enemies Act.
