So, if you see any Britain-fixated Irish politician or columnist suggest that yesterday’s U.K. Supreme Court’s decision should be followed here, you may point out that Ireland’s legal system recognises the CJEU, not the U.K. SC, as its superior court.
Para 32 sets out the test for any Member State to apply when obtaining and then recording the gender of a person.

It hangs on the purpose for which it is collected. If the purpose is to identify the person, then it should

"refer to that person's lived gender identity" not that assigned at birth

I wrote this week's Gist about the State's demand for surveillance power because it's the strand of policy I'm best placed to comment on, but it was partly provoked by the wave of govenment comment complaining that Judicial Review (where the state fails to follow its own rules) is inherently wrong.
