There are lots of ways to stop the Joker without murder. How about paralyze him? Amputate limbs? Deliberate but careful brain damage in a fight? These are all things that Batman could do easily. After the first few escapes, not deciding on a more permanent solution is just irresponsible.

The fact that Batman keeps putting psychotic mass murderers back into the same system that proved it can't hold them is him deciding that his personal ethics are more important than preventing the deaths of countless people. This is not a maybe. This is not a might. He knows this will happen.

So which option is ethical?
1. Turn murderer in again, knowing he will likely escape and kill dozens more before recapture.
2. Wound, cripple or kill the murderer to prevent them from ever hurting anyone again.

Same vigilante shows up and catches the murderer again. Put in a better prison, or maybe the same with more guards. Eventually breaks out, kills dozens more.
Add, rinse, repeat as many times as you like.
At this point: The Murderer has a shocking number of kills under their belt.
