abstract for article called, Bruen's Tenth Amendment Problem: In New York State Rifle & Pistol Association v. Bruen, the Supreme Court created a novel history-and-tradition framework that makes the validity of modern gun laws turn on their similarity to historical analogues. Although scores of commentators have critiqued that approach, this Essay identifies a critical constitutional flaw that has escaped focused attention: Bruen’s test flouts a fundamental Tenth Amendment principle. The Tenth Amendment preserves to States all powers the U.S. Constitution did not divest. This Essay argues that a crucial preserved power is the “Power of Legislative Choice”—the States’ second-order power to choose whether to act or not act. As we show, Bruen’s requirement that each modern legislative action have a historical precursor infringes on this reserved power. By telling States that they cannot regulate today if they did not do something sufficiently similar in the distant past, Bruen removes from today’s State legislatures a whole vista of choices available to their Founding-era predecessors. Bruen thus withdraws a reserved State power that was woven into the Constitution at the very moment the Second Amendment was ratified: the power to do things differently today than before. This Essay concludes that the Court should change course. It should clarify that yesterday’s silence may damn today’s regulations only if historical evidence shows that yesterday’s legislatures would have regulated but for the lack of perceived constitutional power to do so. And it should make clear what kind of evidence counts in this inquiry.
