Also, I would argue maybe the best way to do law school isn't to have the entire semester be subject to one single final exam for the entire grade with no room for fuckup or bad days or anything. Maybe grade inflation wouldn't be as bad if law school classes were based on more than just one final.

Getting in house counsel to write a memo on why the CEO can do an Enron themselves isn't actual law. Even less so for OLC cuz those lawyers can't be accused of violating canons of ethics or be reported to state bars, cuz government/sovereign immunity/etc. /fin

@dondechert.bsky.social Can we just stop pretending OLC is anything other than a political shop for presidential administrations to get justification for whatever they want to do put in nice legalese? OLC memos carry no weight of law or precedent, or shouldn't. /1

Separate topic/question I’ve been meaning to ask you: how come I can’t find nearly any books written on the Rampart scandal?
November 12, 2025 at 1:21 AM
That was a bit different because it wasn't imposed externally by a conquering military. That was internal collapse.

I’ll disagree somewhat about the full denazification only to the extent that 2003 Iraq has shown the perils of going full party removal in states where the party was the state in full. More removals could have been done for sure but it’s a very tough needle to thread.

Your comment was about lefty candidates not being electable. Zohran was the only “lefty” candidate on Tuesday, the others were just mainstream Dems. That was my point.

And clearly we’re not gonna agree about the impact of Tuesday so let’s just leave it at that.

lefty candidates have always been electable at the city level. National is a different story. And the knock a year ago was same as today - national Dems lack the willingness to fight dirty and fight fire with fire and stand for actual liberal values. They care too much about big tenting.

You don’t get to count as “taking heat” if you’ve voted yes for every one of the GOP resolutions

Schumer got tired of fighting to be right, it’s easier to cave and be nothing than fight to be right.
November 10, 2025 at 2:34 AM
Yeah but the fault is the premise that the brand has been rehabilitated. Winning off year elections against sex pests or a party that is literally disappearing people off the street by masked agents isn’t rehabilitating. National dems haven’t shown any sense of spine or principle yet.
November 10, 2025 at 2:33 AM
I’m sorry, when the hell did the brand get rehabilitated? Lots of cringe social media posts attempting to be witty don’t count as rehab.

I am honestly amazed real estate finance didn’t crater the last couple years with the jump in interest rates and uptick in vacancies with WFH. Feels like the house of cards is just being built higher and higher.

it won't. they didn't even have 2nd thoughts after the awful Q3 results

and just think, once his sycophantic cult of shareholders vote him the new pay package, it'll be equal to the bottom 90%
