I'm terribly sorry, but the actual ruling allows for both trans women and trans men to be excluded, using sex-essentialism for women and referring to "male characteristics" for men.

When I finish the piece on this discursive tendency and the gossamer-thin academic rationale that animates it, you're all going to be surprised, yet again, at just how much academics get away with if their work is flattering to hegemonic (and in this case, patriarchal) sensibilities.
Honestly the assumption that all cultures were free of all forms of gendered oppression prior to western colonization is one that should be approached critically in all instances. This isn’t fueled by cynicism. It’s fueled by not wanting to whitewash past oppression to construct a narrative.
