Glad to see this piece out.

It is based on conversations with many Polish judges and other friends.

It relies centrally on the vision of my colleague @kimlanelaw.bsky.social, who was the first to show that binding international and EU law provides a way to escape a national constitutional prison.
Restoring the rule of law in Poland without inflicting further damage on it is a vexing challenge.

JOHN MORIJN (@jmorijn.bsky.social) explains why the Venice Commission could have made this task even more complicated and sketches a way forward.

While EU institutions have by and large stopped paying close attention to the #ruleoflaw situation internally due to the external geopolitical situation, this doesn't mean the internal situation is not worsening when it comes to systemic threats to (and violations of) the rule of law

He was a judge of the European Court of Human Rights, before serving as Supreme Court president. Yet, he was fired by lawmaking. As the ECtHR ruled, he was removed because he was speaking out against laws undermining judges’ ability to properly serve society.
