Overlays are to be avoided, in my opinion! They aren’t likely to prevent companies or organizations from being sued, and teams lose the opportunity to build necessary muscles for accessible design and development. Check out the overlay fact sheet: overlayfactsheet.com

Sometimes, yes! Back to top links are a common version of this. I think more bypass blocks would be good for things like non-modal dialogs, especially since landmark regions can only be navigated with a screen reader.
