There is also the legal principle of restitution outlined in Kingstreet investments against an unlawfully collective tax. If bill C-4 becomes law, then there would be no legal authority for CRA to limit the rebate to the prior narrow scope.

Lowering a tax does not infringe on the financial intiative of the Crown. Even if the tax is already collected and held within the Consolidated Revenue Fund, an individual would still be entitled to be rembursed. Officials confused this in committee.

Para 25 of Opitz v. Wrzesnewskyj is key. " “Affected the result” could also include a situation where a person entitled to vote was improperly prevented from doing so, due to an irregularity on the part of an election official. That is not the case here and we need not address it"

Note that at this time a request for dissolution appears to be a Cabinet decision rather than solely the right of a Premier to ask the LG.

The responding letter says "His honour is unable to concur in the views entertained by council respecting dissolution. The LG without delay will be seeking other advisors"

This challenges the narrative of an orderly transition of government & is similar to the BC LG refusing Clark's request in 2017

The fact that Senators can self designate where in the province they represent can cause neat outcomes like this.

A separate ATIP request had part of a Supreme Court Ruling redacted which is strange.

The issue is although Library and Archives Canada is the holder of the document, they must consult with Justice which seems to have a haphazard approach to historical documents.
