Contested election appeals are appealed directly to the Supreme Court of Canada (Per Saltum) under section 532 of the Canada Elections Act within 8 days of a decision.

This is a rare bypassing of a normal appellate court and the SCC must hear it without delay #cdnlaw #cdnpoli

LG Wilmot then invited Andrew Blair to form a new government.

Note that at this time a request for dissolution appears to be a Cabinet decision rather than solely the right of a Premier to ask the LG.

The responding letter says "His honour is unable to concur in the views entertained by council respecting dissolution. The LG without delay will be seeking other advisors"

This challenges the narrative of an orderly transition of government & is similar to the BC LG refusing Clark's request in 2017

Discovered in the New Brunswick provincial archives that the Hanington government did not first resign in 1883 when defeated on a confidence vote. Rather the entire executive council wrote to the Lieutenant Governor requesting a dissolution and a new election

After over 3.5 years, I finally received a response to an Access to Information request for a 105 year old document governing the time that PEI had no Lieutenant Governor during an election.

Standby for an academic paper on the matter in the coming months.

The role of a Parliamentary Secretary is whatever the relevant Minister directs. So it is a fairly elastic position.

There is also wide latitude in the title of a Parliamentary Secretary.

Section 32 of the Parliament of Canada Act provides for the historical ban on any MP accepting a paid office in the Government of Canada. Parliamentary Secretaries (like Ministers) are an exception to this rule. S.33(3)

The Labour Board appears to not have the ability to enforce its own orders.

It has to go to Court to do so. Which obviously takes time.

Notwithstanding that the board can't undertake an unconstitutional action, it exceeds the statutory purpose of s.107 by making s.90 not applicable which allows for Cabinet to prohibit (with a higher threshold for invocation ) a disruption during an election when laws can't pass.

I am going to presume that most trails folks have concerns about may have been closed by a local municipality. That is an issue with that city not the provincial ban. The provincial powers can only affect Crown Lands maintained by the department Natural Resources. #nbpoli

The vast majority of Forested Crown Lands in the Province are located in remote areas where people do not live.

New Brunswick's response is proportionate and does not impact private forested areas or municipal forests or trails.

I would suggest that @Gov_NB revise this section to say that the ban applies only to Crown Land under the administration and control of the Minister of Natural Resources to avoid folks being ticketed for being on other Crown land that is allowed (school playgrounds) #nbpoli #cdnlaw

The New Brunswick Government updated its fireban website to cite the legal authority for banning all industrial and recreational activities on Crown Land (administered by the Minister of Natural Resources).
