I am pleased that the Speaker of the House of Commons clarified that amendments which extend the GST housing rebate scope in bill #C4 do not require a Royal Recommendation and are admissible.

Any MP or Senator can move an amendment to lower a tax. #cdnpoli #cdnlaw

Contested election appeals are appealed directly to the Supreme Court of Canada (Per Saltum) under section 532 of the Canada Elections Act within 8 days of a decision.

This is a rare bypassing of a normal appellate court and the SCC must hear it without delay #cdnlaw #cdnpoli

My favourite time of the New Brunswick Parliamentary Calendar. The Prorogation Ceremony formally marking the end of a session of the Legislative Assembly followed by a 2 hour break where MLAs can have a lunch unburdened by any legislative obligations until the Speech from the Throne. #nbpoli

Happy to talk to CBC NB about New Brunswick's 1785 election. You really can't find a more chaotic experiment in democracy: on one hand, all men who lived in NB for 3 months could vote.

However in Saint John the local sheriff "rigged" the election! #nbpoli #cdnlaw

Discovered in the New Brunswick provincial archives that the Hanington government did not first resign in 1883 when defeated on a confidence vote. Rather the entire executive council wrote to the Lieutenant Governor requesting a dissolution and a new election

The easy fix (which the bill doesn't do) for Quebec to amend its interpretation act to define the term "Officer of Quebec" as meaning the "Lieutenant-Governor of Quebec" so that there is still a constitutional linkage to the office.

Quebec can't alter the formal name of the office.
For the record, the NAME of the office is undoubtedly part of the "office of" the LG for the purposes of the constitutional amending formula, which requires the approval of the House of Commons, the Senate, and all ten provinces. Quebec can't unilaterally rename it.

After over 3.5 years, I finally received a response to an Access to Information request for a 105 year old document governing the time that PEI had no Lieutenant Governor during an election.

Standby for an academic paper on the matter in the coming months.

Recall: the Minister cannot order an end to the Labour dispute. They are directing the Labour Board to order an end to the Labour dispute. As the CIRB has not issued the order, the Labour dispute can still continue for now.

My prediction: the Courts will find that the use of s.107 for the Minister to direct the labour board to order binding arbitration to end a labour dispute is both unconstitutional and exceeds the statutory purpose of s.107 as it makes back to work legislation moot. #cdnlaw

The vast majority of Forested Crown Lands in the Province are located in remote areas where people do not live.

New Brunswick's response is proportionate and does not impact private forested areas or municipal forests or trails.

The New Brunswick Government updated its fireban website to cite the legal authority for banning all industrial and recreational activities on Crown Land (administered by the Minister of Natural Resources).
