NEW: Hawaii's Supreme Court keeps releasing opinions that denounce the U.S. Supreme Court.

The latest? A new ruling that requires the police to record all interrogations from now on.

The author took it as an opportunity to say Hawaii's court will protect due process—while SCOTUS isn't:

After ruling the NIH grant terminations illegal, Judge Young ended the hearing with an eye-opening speech.

The US Court of Appeals for the Ninth Circuit has extended the stay of Judge Breyer's order returning control of the National Guard to Gov Gavin Newsom until Tuesday to allow them to be briefed and consider the matter. Observers expect them to affirm Breyer and for Trump then to appeal to SCOTUS.

Even *if* you accept Stephen Miller’s (textually, historically, and morally indefensible) claim that undocumented immigrants are not entitled to due process, you’d *still* need due process to ensure that the individuals at issue are, in fact, undocumented.

His argument fails even on its own terms.

The 10th Circuit US Court of Appeals has DENIED the govt a stay of a state-wide temporary restraining order against removing aliens under the Alien Enemies Act without 21 days notice, in a language the alien understands, advising of his or her right to bring a challenge in habeas.

In the law firm executive order cases, DOJ takes the position that an injunction barring implementation will only be enforceable against the govt agencies named in the complaint. So Perkins Coie just amended its complaint to name all the relevant fed agencies. The case caption is now 40 pages long.

So to sum up the Wisconsin arrest issue:

ICE didn't have a juridical warrant. They only had an administrative warrant.

The DOJ has not convened a grand jury to indict the judge. They only got a criminal complaint before a magistrate judge.

This is ridiculous.
