Prohibiting words doesn't mean kids aren't going to be shitty to other kids. Intervening and identifying it as disrespect and bullying allows for, if nothing else, consequences around learning to respect other people versus just a punishment for using a banned word.

But I don't think saying you can't misgender someone will do anything besides make kids find new ways to be just as hostile and demeaning to trans kids. I think that treating misgendering as bullying versus prohibiting misgendering would be more effective.

Because I don't think using government action to mandate basic human decency works. I think government can effectively let trans kids use the bathroom that corresponds with their gender and can mandate that schools allow participation in sports.

I've only been able to do that in the context of other precedent. I don't particularly like how broad the 1A is. But also I don't see how blanket prohibiting misgendering accomplishes much. I don't think the Constitution can resolve this. I think it's better handled in the framework of bullying.
