NEW: Alabama AG goes to SCOTUS on the shadow docket (No. 25A347) to stop an Eleventh Circuit decision from going into effect on Sept. 30 that would force the state to retry a man on death row b/c the 11th Circuit held, 2-1, that the state discriminatorily used its peremptory strikes.
