Completely bizarre argument by DOJ regarding USAID impoundment. The judge has already shot this exact argument down in the preliminary injunction, will be interesting to see how he reacts to DOJ lazily returning to this argument with no new evidence that there's any intent to obligate funds.

This will set up an interesting confrontation on impoundment in the next 2 weeks. By Thursday the government is required to provide an update on steps they've taken to comply with an order to not impound USAID funds, to which they'll have no update since they haven't taken any steps to comply.

Ridiculous where Lewin uses the pre-DOGE destruction number of 2000 overseas staff to inflate his responsibilities. The reality is nearly all of these people have been recalled and fired, there aren't even 2000 USAID employees total anymore, nevermind overseas.

This part by the govt highlights the extent of their non-compliance. There was nothing unique to the Feb 25 order that wasn't already required by the Feb 13 TRO. We're already 24 days since the TRO, and they're admiting that they still haven't started the process and would need 30-45 days from now.

Just reading through the latest Marocco filing highlights the absurdity of how they're handling. Despite previously telling the court 2 weeks ago they were processing a (pathetically small) amount of the payments, he's now saying they're still sitting even on those payments for policy reasons.
