The ICJ decision to dismiss the case against the UAE charged with genocide in Sudan will only embolden them to ramp up their support for the RSF including their drone support. These international systems of justice don't work, they merely delay justice.

That leads me to another aspect of the arrest warrants: The ICC is based on “complementarity”, it doesn’t act if states themselves are willing AND able to go after “their” criminals. Netanyahu could and should allow domestic proceedings against himself. Israel has a functioning legal system.

One could still try to argue that Netanyahu enjoys immunity because Israel never joined the ICC. But that would contravene an old practice: no immunity for grave crimes. Netanyahu should rather focus on showing he didn’t commit them instead of saying no court is allowed to look at his actions.

BUT the ICC is, as the name says, an international court. And there is a legal tradition to disregard immunities in international courts than can be traced back all the way to the end of the World Wars until Milošević, al-Bashir; Putin and now Netanyahu. The ICC statute itself is clear (art 27) 👇🏻

Now what about the substantial arguments? First, immunity: In general, prime ministers (like heads of state and foreign ministers) enjoy absolute immunity in the courts OF STATES (par in parem non habet imperium, states are legal equals and thus one state cannot rule over others).

The ICC does not treat Israel and Hamas identically or as morally or in any other way equivalent. They are involved in the same war, that’s why their leaders treated in parallel. But they are accused of different crimes because they (might) have committed different crimes. Simultaneity ≠ equivalence
