ICE policy says a person can be deemed a gang member if any ICE officer notes two "Gang Membership Identification Criteria." In Mr. Reyes Barrios' case, that appears to have been:
1) A tattoo modeled off the Real Madrid logo
2) A picture from social media of him throwing the horns.

First, he has a tattoo on his arm of a crown sitting atop a soccer ball with a rosary and the word "Dies." OHS alleges that this tattoo is proof of gang membership. In reality, he chose this tattoo, because it is similar to the logo for his favorite soccer team Real Madrid. See logo below. ' [A picture of the Real Madrid logo, which is a crown on top of a circle loking a bit like a soccer ball. This is compared with a picture of Mr. Reyes Barrios tattoo, which has both a crown and a soccer ball, along with some other designs flowing out of those central pieces]. 8. Second, OHS reviewed his social media posts and found a photo of Mr. Reyes Barrios making a hand gesture that they allege is proof of gang membership. In fact, the gesture is a common one that means I Love You in sign language and is commonly used as a Rock&Roll symbol.
