the constitution says you must be 35 to be eligible to serve as president. now, let’s say a presidential nominee was born on february 29, 1972, a leap year. and let’s say they were running in 2024. now, technically, they would only be 13. you could say they were ineligible. but that’s stupid! (1)

I know why we focus on the rule of law here. I also get that a lot of the electoral machinery would have to subvert itself for this happen.

I also think it is reasonable to take this seriously. There’s a pattern. Hyperbole, stress test, act.

Hearing that DOGE went into the Dept of Education today and shut down almost the entirety of the department's in-house research arm, Institute of Educational Sciences, cancelling contracts totally about $900m.

the constitution is a public and political document as much as a legal one and constitutional meaning is a public and political process. trump can say X but other political institutions, and the nation’s various publics, have to agree for it to mean anything

So I’ve had my 1st Black History Month event cancellation because of “DEI concerns,” citing a fear of frivolous suits. Funny thing is, I don’t do DEI, I’m a historian of the Black American experience. A reminder that DEI is just a dog whistle about suppressing history, if you need a reminder.
