Such transfer/deportation is also a war crime.
Meanwhile, “flattening” Gaza would entail the war crime of extensive & wanton destruction.
Occupying Gaza indefinitely would violate Israel’s obligation to end its presence as rapidly as possible, per the ICJ’s 2024 opinion. 2/2

The crime against humanity of deportation/ forcible transfer includes “taking advantage of a coercive environment.” Labeling migration “voluntary” in that context is legally meaningless.
When done discriminatorily, this implicates persecution as a CAH. 1/2
