The "proper role of judges" includes acting swiftly and firmly to restrain an Executive who violates the Constitution in multiple ways by kidnapping citizens and dumping them abroad.

No amount of hand-waving by you or SCOTUS can justify allowing it to happen to even one person, much less thousands.
The fight here is not (or shouldn't be!) about left versus right.

The fight is about the proper role of judges in our democratic system.
