This is the crux of the whole should-soldiers-disobey-unlawful-orders debate. When the system is working, commanders don't typically issue unlawful orders. And when they do it's certainly an enormous burden on the soldier to make a choice. But the current flood of unlawful orders changes everything.
Honestly, the entire thing strikes me as an example of terminal lawyer-brain. The truth is that the point at which a civilian authority is issuing manifestly unlawful orders, you've entered a state of exception and the truth is a soldier can end up being shot for obeying or refusing.
