Great breakdown of the arguments today, and I always appreciate some measured optimism
1/X As promised, here is a thread with my impressions from the oral argument in US v. Skrmetti this morning (this is the case challenging TN's ban on gender affirming for transgender minors). In addition, if anyone wants more background, my pre-oral-argument explainer on the case is linked here.
1/X An important Equal Protection case, United States v. Skrmetti, will be heard by the SCT tomorrow (Wed. Dec. 4). For those who have not been following the case closely, a 🧵 about the case, why it is important & what to watch for. I'll do my best to explain in lay terms & stay away from legalese.

I’ve been thinking a lot about how much I want to stay on top of the news right now. I feel an obligation to know what’s going on but a strong desire to tune everything out.

I think my plan will be to read what I see on Bluesky but otherwise just keep up with CJ issues.
I’ve quit listening to the news cold turkey because I just…can’t. I think over the next four (or however many) years, I will be ingesting the *bare minimum* required to stay productively informed, for my own sanity
I’ve intentionally not been wallowing in politics but oh boy every day is worse.

Others have defended Biden’s pardon on the grounds that the charges Hunter faced were rarely brought and likely politically motivated.

If that’s an appropriate reason for a pardon, then Biden should be pardoning others whose prosecutions fit that description as well, not just his son.

Hunter's pardon better be the first of a huge flurry of commutations. There are so many cases even more deserving than this one that the Pardon Attorney has recommended granting, and they're just waiting for Biden's signature. It would be inexcusable to see injustice only when it's a family member.

With all respect to OP, this feels like the "only Republicans have agency" theory of politics.

Biden operates in the same world where Trump handed pardons to all sorts of crooks who supported him. He lowered the bar before Biden walked in; Biden just didn't take advantage until now.

Trump is poised to abuse the pardon power more than any president in history. Biden just undermined that objection. Democrats are going to lose the plot reflexively defending him or engaging in whataboutism.
