it is the Imperial Judiciary when courts say that presidents can’t unilaterally overturn constitutional text, and the Proper Order of Things when courts say that your rights rest on the whims of who happens to be in office
Woah. Fierce cut-down of the junior justice by the next-most-junior justice.

Conservatives’ constant reframing of “expanded rights for all” as “special rights for a few” is immensely destructive, and it flows from the philosophy (most refined in Trumpism) that if something is not personally beneficial to me, then it is a loss for me and must be opposed.
this is also not new. the Court's using the same argument for 'equal application' of interracial marriage bans

then: *no* person can marry outside of their race, *any* person can marry within their race :)

now: *no* kid can treat gender dysphoria, *any* kid can have hormones for other reasons :)

Everything that’s happened over the past six months has been a response to an imaginary crisis. There is no immigrant invasion. No trade crisis. No scientific or governance crisis. Just people completely high off their own supply trying to fundamentally reorder society. None of this had to happen.

ICE has abandoned almost all the trapping of a lawful arrest. Its officers cover their faces, conceal their identities, use gratuitous force, and transport their targets across state lines to stop courts from intervening. The distinction between an ICE arrest and criminal abduction is disappearing.

I don't really care what the "political consequences" are of fighting for the proposition that *everyone* is entitled to due process before they are removed from the United States and sent to a Salvadoran prison.

It's not really a principle if you only adhere to it when it's politically expedient.

The reason the conservative intelligentsia has spent decades pretending that societal shifts in cultural attitudes are the same as state coercion is to justify the use of state coercion against the elements of society they disapprove of.
Here's one of the many clarifying passages in the White House (notionally GSA) letter. It demands Harvard set up a system of political commissars who will enforce hiring and admissions set asides for MAGA luminaries and high school red hats.

So I did the math. Columbia needs a 2.7%-ish annual return on 15 billion dollars to replace the 400 million the government is threatening to pull. Not a heavy investment lift.
Columbia has a $15 billion endowment. All the ivies and many other universities are sitting on billions. What is the point of the endowment if not to help the university retain its independence? www.wsj.com/us-news/educ...

As always, not a lawyer, but one thing that leaps out at me about how things are going down in the courts right now is that the US court system is not designed to be responsive to a crisis like this one. A crisis like this one is not what it's FOR.

/2 Today the demand for “moderation” calls on people to accept the Right’s hysterical bad faith framing of trans issues in a way that demeans humans and reduces liberty. If you do that their next demand will be that you abandon some other group or value.
