WTF
The House just voted that “each day for the remainder of the 119th Congress shall not constitute a calendar day for purposes of section 202 of the National Emergencies Act.” A day is not a day. Lewis Carroll, George Orwell, and Franz Kafka must all be chuckling — or weeping.

A major portion of the statute was struck b/c it stepped on federal toes. If the feds are doing it, then what are the legal objections?
1. Alabama tried this in 2011. The courts held that the law's key provisions (and most of the rest of it) was unconstitutional. www.justice.gov/usao-ndal/pr...

Appearance of Corruption at the very least

I think women might want to leave Missouri.
Under His Eye
A Missouri Representative has filed a bill to track pregnancies in the state.

HB 807 will: "Maintain a central registry of each expectant mother who is at risk for seeking an abortion of her unborn child and make the same available to a prospective adoptive parent who has completed screenings."

Corruption. Corruption. More corruption. One facet of fascism.
"The entire force and power of the United States government is now part of the business support structure for the Trump family."
The Oval Office meeting convened by President Trump sought to figure out a way to eliminate roadblocks to the planned merger of the PGA Tour and Saudi-backed LIV Golf. His participation was a brazen conflict of interest, former prosecutors and ethics lawyers say — one of a series in recent weeks.

Bezos may own the WP, but Musk and Trump own Bezos. I thought Bezos was a risk taker. Evidently not.

These laws burden protected expression. I suppose protecting children is compelling, but It seems overbroad to include printed material. We have seen government abuse in this field time and time again. Ulysses. Tropic of Cancer. Lolita. The naked Linch. We should be very, very skeptical.
We're looking at 2 states — Florida & Tennessee — with age verification laws for social media & for porn, though the SM part of the Fla. law is on hold

Copyright cases are money cases. The government is not a party and no law is involved, so the 1st amendment is not burdened. However, if open AI gets to use articles without permission why can’t I? Because we believe in the rule of law.

When you post on facebook your words are your own, but beyond your home page it is Mark Zuckerberg speaking. In neither case is the first amendment invoked.

I read the SCOTUS tik tok opinion. Use of the incidental regulation test can be controversial. It seems reasonable here despite the huge impact on expression.

Pathetic and true. Korea will not reward person who lead these events, however.
At this rate, we’re going to have a national monument on the lawn of the Capitol dedicated to the rioters.

Another conflict of interest. The list keeps getting local and the political norms continue to disappear. I hope that both political parties object to the other's conflicts, but it would be nice if they also abided by their own internal ethics. The rule of law fades further away.

One perspective - It is kind of fun to see wealthy people bend a knee. On the other hand - it is not fun to see a politician expect a bended knee. The system is so broken and corrupt.
Time flies!

A perfect example of bad apples tarnishing law enforcement as a whole. 4th Amendment search and due process violations. Sue the hell out of this police department, 42 U.S.C. 1983. The penalty for this is loss of job and damages. Disgusting.
I’m grateful to & proud of the DOJ SDNY Civil Div for undertaking this comprehensive investigation & exposing these horrible abuses against the people of Mount Vernon. I’m humbled to have played a small role in this process. www.nytimes.com/2024/12/12/n...
Mount Vernon Police’s Strip Searches Were Unconstitutional, U.S. Says
A report by federal prosecutors found that a Westchester County police department violated the Fourth Amendment “on an enormous scale.”

She has a decent first amendment defense.
My normie liberal takes are as follows

1) Summary execution/cold blooded murder is bad, and cheering it is toxic to the soul.

2) The US healthcare system is a moral abomination and single payer would be much much better

3)Charging this woman with this crime is an insane miscarriage of justice

I was called two jury duty, but I was co-counsel for the defendant. The judge granted my request to be dismissed.
I was empaneled on a jury in New York County Civil Court once in the 90s. Bodega slip-and-fall. Case settled after opening statements, and I was so bummed lol

Broken? Agree, but you're only saying that because you are making the purchases. Students have been making spendy purchases (tuition) for years and saying the system is broken, but you failed to listen. How does it feel to have higher costs rammed down your throat? Fit it for colleges and students.
West Virginia president Gordon Gee: "Yes, (college football) is broken. The reason it's broken, we've gotten into a consumer oriented approach. W/out a doubt college football is broken. We have to fix it" #SBJIAF

Another conflict of interest. Another profit. Banana republic stuff that flies in the face of the rule of law.
Eric Trump now in Saudi Arabia to "launch" the start of the latest luxury high rise Trump Tower this one built/financed by Saudi-based Dar Al Arkan. This one will be in Jeddah. Others with Dar Al Arkan in Oman, Dubai and Saudi Arabia. Trump family gets an upfront fee and a cut of unit sales price.

Do you think the judge who attacked your character will now call and apologize? I mean it's possible. Congrats.
I'm beyond excited that "The Shadow Docket" has received the 2024 Order of the Coif book award.

Even better, I get to share the honor with one of my favorite legal historians—@ucberkeleylaw.bsky.social's Prof. Dylan Penningroth:

I had to look up chode. That works as a standard for me.
Reupping this courtesy note. If I block you, please do not take it personally. It’s just because your posts have become too stupid to read anymore. Or you are a retromingent chode. Thank you for understanding.

One system you do not want is a leader having the ability to determine your citizenship. That would be abused, for certain.
Imagine this ridiculous idea in practice. *Every* American's citizenship would suddenly be in doubt unless they can prove
a) they were born in the US
AND
b) both their parents were in the country legally.

Do you have certified copies of your parents' birth certificates?
President-elect Trump has revived talk of abolishing birthright citizenship — the guarantee, enshrined in the Constitution for more than 150 years and rooted in common law, that anyone born in the U.S. is an American citizen. Here's what to know.
December 10, 2024 at 6:23 PM
And toys, evidently.
Find someone who looks at you the way we look at books.
December 10, 2024 at 12:27 PM
Non-citizens from any country in the world can purchase these goods, and the money goes to the campaign. That is a nice work around campaign laws. Of course, no one cares because it is so far down the list of ethical norms being violated. Sad.
Now, let’s see: If Trump were to shoot and kill someone on Fifth Avenue, would the headline read, “𝙏𝙧𝙪𝙢𝙥 𝙏𝙚𝙨𝙩𝙨 𝙈𝙪𝙧𝙙𝙚𝙧 𝙇𝙖𝙬𝙨 𝙒𝙞𝙩𝙝 𝙆𝙞𝙡𝙡𝙞𝙣𝙜𝙨 𝙞𝙣 𝙈𝙞𝙙𝙩𝙤𝙬𝙣”?

I dislike conspiracy theorists, especially when the opinion appears to be from a position of influence and done to make a buck. Disgusting.
