Note to editors and producers: If an executive order demands action that is illegal or outside of the president’s authority, then you should not describe it as ordering something. You should say it seeks to achieve some outcome and then note it is illegal or beyond the power of the president.

Disappearing people to avoid the jurisdiction of the court in which they were taken by the state is authoritarian to the core and runs afoul of the spirit of Article III, the Due Process Clause, and the principles that emerged from the Glorious Revolution and the American Revolution. I answer no, analogies are always imperfect but to me it feels more like Russia 1999: a blatant theft of state assets and liberals in a fugue state, refusing to believe the arc of progress is bending against them.

repeating myself a bit here but trump can issue an executive order but that doesn’t necessarily mean shit if it doesn’t have a firm statutory basis. if congress lays out in law what the duties of a particular official are, then no, the president can’t decide those duties are something else

Received a letter from POTUS today purporting to remove me as Commissioner and Chair of the FEC. There's a legal way to replace FEC commissioners-this isn't it. I've been so fortunate to serve the American people and stir up some good trouble along the way. That's not changing anytime soon.

Everyone seems to be framing Trump's freeze on federal grants as a Constitutional fight over powers of the purse & whether presidents can disregard Congressional appropriations. It is that. But also at stake is the fundamental validity of government contracts! I see much less discussion on this... 🧵

If you are a federal worker being offered a buyout, I would advise against taking it.

Of course, this is a personal decision for everyone and it’s your choice.

But these offers are a rush job. The legality is questionable and this admin does not keep to its word.

They aren’t firing for a reason.

This is grossly irresponsible reporting by the AP. What’s being offered is not a buyout. The deal is if you agree to resign in September you can continue working remotely until then. There is no buyout or severance.

If you’re in an institution doing any kind of DEI work, the most important thing to do right now is simply call it something else. Change it to “Community Outreach” & then keep on doing the same important work. When they outlaw Community Outreach rebrand it as “Strategic Partnerships,” rinse/repeat.
