One silver lining I hope comes from this is that ... all this ... is that it pushes law profs to move away from teaching in a way that too often (strongly) suggests that "the law" is almost entirely what is written in statutes and opinions, not how those charged w enforcement choose to follow them.

absolutely correct - the death penalty jury selection process eliminates just about anyone who would even consider finding any defendant NG
Just realized this may be another reason Feds want in:

They can death-certify a jury.
Since NYS doesn't have the DP, not sure it can.

"Death-cert" = in capital cases, DAs are allowed to ask potential jurors if they could impose death. if they say no, can kick.

Gives you a tougher-on-crime jury.
The Mangione jury selection is going to be wild.
