I will forever have an axe to grind with this phrasing in the INA. True sleaze to frame it as a “right” and “privilege” to be able to be represented “at no expense to the government.” Even as a legal professional I feel like it requires a double take to understand it’s a denial of appointed counsel

Here in Part II, Barrett joins the dissenters (she did not join the majority in any part). This section highlights and recites the meaning of the language I referred to as “Roberts taking his medicine,” given how pained he is to acknowledge it outright. Good, strong, worthy language here.

Yerrrrrp. Roberts loves to plead procedural or jurisdictional grounds while using the Court’s authority to whisk this case away from diligent procedures well under way. One may note that this relieved the gov’t. And one may think cynically that Roberts rules this way because it relieves the gov’t.
