The Muscogee SCT explicitly invokes the importance of the 1866 Treaty in McGirt: "The Nation cannot choose to select and rely on portions of the Treaty... as evidence of its intact reservation & also negate the clear language entitling...the Creek Freedmen...eligibility for citizenship."

At noon my weather app said maybe rain at 3 am, dry until then. So I biked to school and now this is outside my window. I know weather is changeable, but I can’t help thinking this is the fault of #DOGE & the cuts to the #WeatherService & #NOAA

U.S. Supreme Court records and briefs is a print resource probably available in many libraries, and is also available as a paid database on line. In addition to briefs, it also has lower court records. It's awesome.

The judge points out a broader issue: we assume that people aren't lying to us; it's necessary to have communication work. But that's not the norm from the administration, and it's not the norm from AI. Lawyers: resist. Do your own &*@$ research.

2/ Thank you to turtletalk for the shout out! With one of Matthew Fletcher's amazing cartoons below. As he says, this is also very much the story of the DNA-People's Legal Services, one of the first #LegalServices programs in the country, which brought the case.

For something not at all relevant now, my new article challenging governmental abuse, winning & making big change. McClanahan v. Arizona (1973) arose from a young Navajo woman's challenge to $16.29 in taxes & created a legal foundation for tribal self-determination

And for the substance of the argument: she’s trying to use a case that got granted cert on the narrow question of the standard for damages under the IDEA to get the court to write reasonable accommodation out of the ADA and 504 too

read Raffi’s thread for highlights but the argument is just banana pants. She interrupts the justices so much that Kavanaugh at one point has to tell her he’s trying to ask a helpful question to get her to stop

🧵2/ This isn't the first time the lawyers have argued Elk v. Wilkins, holding a Ho-Chunk man wasn't a birthright citizen, means allegiance or consent or something else. They tried it in 1898 in #WongKimArk. #SCOTUS rejected the analogy:

#Property folks--the 10th Circuit affirms that landowner's can't prevent hunters using a ladder to move from one corner of public land to another, although the ladder "enters" the private owner's airspace. 1/3 www.ca10.uscourts.gov/sites/ca10/f...
