HB121 passes the Montana House of Reps 58-42, the first bathroom ban to pass in 2025 a legislative chamber.

The bill would ban trans adults from state and local owned bathrooms of their gender identity.

By virtue, it would also target rep Zooey Zephyr in bathrooms.

Sad day for trans Montanans.

Zephyr: "This bill came across in Ohio. In Ohio, a trans man was forced to use the women's restroom. He was followed in and assaulted for using that restroom."

Zephyr: "The private right of action lets someone accost someone who they don't think is woman enough... that is opening the door to real dangers, to real predators, making it easier for them to accost and harass people."

Rep Zephyr: "When opponents came in on this bill... cities came in, universities employees, reps for the university students, reps for the DV shelters across the state came in and all said the same thing. We have trans people and we care for them, and we provide for them without issue."

Rep Barker: "I think there's been a lot of smoke and heat around this particular conversation... I am concerned about a couple of provisions in this bill that may actually make women feel less comfortable. I'm concerned about enforcability of the bill and unknown liability."

"Biological differences matter. Pretending they don't provides confusion and danger."

Transgender people are often biologically much more closely matching their gender they have transitioned to than their assigned sex at birth.
