It's worth noting that the EHRC maintains its trans exclusionary legal position in its draft Code of Practice. But the decision whether to lay that Code remains with the Minister, not the EHRC. Hence their angry letter to Bridget Phillipson today.

After six months of confusion and delay, the EHRC has taken down interim guidance rushed out in April. But the damage has already been done.
