A state or UNSC referral is not required for Rome Statute crimes with elements occurring on the territory of States Parties, as evinced by the investigation in the situation in Bangladesh/Myanmar, which followed a proprio motu request from the Prosecutor based on Bangladesh being a State Party
No, the ICC generally does not have direct jurisdiction over the United States or its nationals for crimes, including maritime offenses, because the U.S. isn't a party to the Rome Statute (the ICC's founding treaty). (exception being by referral for a crime)

The thing is that Trump, Vance, Rubio, et al. also absolutely know the Court has jurisdiction over US nationals for crimes with elements on the territory of ICC States Parties, and they are absolutely terrified by it

If you're a journalist and you're just gonna parrot Rubio et al.'s line that the "US does not have jurisdiction over Israel & the US," at least include a disclaimer that the Court absolutely has jurisdiction over Rome Statute crimes by persons of any nationality on the territory of a State Party

Reiterating that I had to get an OFAC license to conduct research involving interviews with FDLR and M23 members, groups under US sanctions whose leaders were facing ICC charges, c. 2013-2015, and I now would likely have to get a license to interview ICC judges and prosecutors
The US government has imposed sanctions on two additional ICC judges in order to shield Israeli officials from charges of grave international crimes.

These sanctions are the latest attempt by the Trump administration to blatantly interfere with independent justice.

I am just gonna say that there is one really easy way to never have to worry about an ICC arrest warrant whether or not you are a national of a State Party, and the cool thing is that that easy way actually involves not doing things, so it actually requires no effort whatsoever

Look I don’t know if JD Vance or Marco Rubio or Pete Hegseth will ever end up in the dock in The Hague (stranger, more unexpected things have happened) but do you know how mad it would make these guys if there was an ICC arrest warrant and they couldn’t travel to Europe after leaving office?
