I kept waiting for the allegation of a false statement of fact. Didn't happen. The complaint seems to hinge on the notion that "being bought" by billionaires must mean a clear, specific payoff. That the book is saying there were cash payments made in exchange for lies and propaganda.

I lived in Moscow in the 90's. It took me a while to realize that the Taibbi byline in the USA was *that* Taibbi. He tries to excuse his eXile days as satire, and maybe that excuse works in the USA all these years later. If you were there, though, it was staggeringly misogynist sex-predator stuff.

I tried to read it from the point of view of a judge who doesn't want to kick on 12b6 and is looking for something, ANYTHING, that is good enough to warrant giving to a jury. I got nothing.

I just read it again. I'm not seeing anything that is even close to statement-of-fact territory. There's a few things that allude to defamatory material in the book, but they didn't bother to include what exactly the material actually is.

Agreed. Would be surprised if this survives a 12b6. So, the people who have been saying "can't wait for discovery" can be disappointed. Doubt this case can even make it to discovery. I don't know Judge Daniels at all, but he seems like a normal judge who should see through this.

Read the complaint. It's ridiculously weak. Doesn't even attempt to show actual malice. Repeatedly cites opinion statements as if they're factual.

If someone sues me for saying something on the internet that hurts their feefees, even though it's true, my insurance company will pay @hipcrimevocab.net and @goobermunch.bsky.social to make them regret this fact! It's especially important for me, because my state has a terrible anti-SLAPP law.

--and the statement "JK Rowling is a fucking bigot" *is* fully protected in US defamation law as a statement of opinion and not fact. It's still expensive to get a meritless defamation suit thrown out unless your state has a good anti-SLAPP law (and not many do!)

This is because for every dollar you spend on Harry Potter media or merchandise, a large portion of it goes to Head Bigot JK Rowling, who specifically uses that money to finance her fellow raging bigots threatening ruinous lawsuits against UK people who point out their raging bigotry.

The UK has since made some changes to their laws to downgrade them from "completely batshit draconian fuckery" to "mildly batshit draconian fuckery", but it remains batshit draconian fuckery that has a significant chilling effect, particularly on calling a raging bigot a raging bigot.

The law in question is the SPEECH Act of 2010 (www.congress.gov/bill/111th-c...) and while it prevents all libel tourism from countries with less protective law than the US, it was specifically enacted in reaction to the UK's batshit draconian defamation laws.
