After 4+ years of litigation, the 5th Cir ruled that FDA's proposed graphic warnings for cigarettes did NOT violate the 1st Amend.

Now Judge Barker (E.D. Tx.) has again indefinitely blocked the rule, finding FDA likely violated the APA bc it lacked authority to increase # of warnings from 9 to 11.
